Rahul Gandhi will have to challenge the decision of the district court of Surat in High Court as the Court rejects his petition seeking a stay of conviction in a defamation case. This will further make Rahul's candidature in the coming election uncertain.

Last month, the Congress party's ex President Rahul was convicted by a district court in a defamation case brought by a legislator. He objected to the statement of Rahul Gandhi where he in an election rally commented on people whose surname Modi.

Rahul Gandhi while taking the name of lalit Modi, Nirav Modi, who are facing trial in Indian courts for various reasons went on including the name of Prime Minister Modi and all other people having Modi surname.

The district court in Surat city had sentenced Gandhi to two years in prison for his 2019 remarks referring to two fugitive Indian businessmen, both surnamed Modi.

Gandhi, 52, lost his parliament seat in March after being convicted and sentenced to two years in jail for the Modi comments.

The law that governs elections in India mandates disqualification of any politician who is “convicted of any offence and sentenced to imprisonment for not less than two years”.
