The SC rejects the petition that contested Yogi Adityanaths inability to be prosecuted

On Friday, the Supreme Court rejected an appeal that contested the decision to refuse permission to charge Uttar Pradesh Chief Minister Yogi Adityanath in a 2007 case involving hate speech. The appeal contesting a decision from the Allahabad High Court was denied by a bench consisting of Chief Justice of India NV Ramana, Justice Hima Kohli, and Justice CT Ravikumar.

The bench has recently reserved its order after hearing both parties' submissions. Parvez Parwaz has already brought a case opposing the Allahabad High Court's ruling in 2018. In a meeting conducted in Gorakhpur on January 27, 2007, the petitioner Parvez Parwaz claimed that Yogi Adityanath, as the head of a group named "Hindu Yuva Vahini," had incited animosity between the two communities.

When the Allahabad High Court rejected the appeal, it stated that it had not seen any procedural irregularities in the investigation's management, the decision-making procedure for withholding sanctions, or any other aspect of the ruling that would have called for this Court's interference.

After reviewing the complete file, the Law Department of Uttar Pradesh issued a report on May 1, 2017, noting that there is no rationale to sanction prosecution in the absence of evidence. In agreement with, Special Secretary Home A note dated May 1, 2017, containing the Law Department's judgement, was submitted for the Principal Secretary Home's approval.

On May 3, 2017, the Principal Secretary of the Home Department approved the Law Department's recommendation after agreeing with it, and the Joint Secretary of the Home Department signed an order in this regard that is being contested in the case.
